1. Acceptance of Terms

By accessing or using Zetyra (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Zetyra provides web-based statistical design calculators for experimental design, including sample size calculators, CUPED variance reduction analysis, group sequential design tools, and Bayesian predictive power calculations. The Service is available in free and paid tiers.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscription and Billing

Free Tier

The free tier provides access to basic sample size calculations with no payment required.

Pro Subscription

The Pro subscription is billed monthly at $99/month. Your subscription will automatically renew each month unless canceled. New subscribers receive a 14-day free trial.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period. We do not provide prorated refunds for partial months.

Price Changes

We reserve the right to modify pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without authorization
• Use automated systems to access the Service in a manner that exceeds reasonable use

6. Intellectual Property

The Service, including its design, code, and content, is owned by Zetyra and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive license to use the Service for its intended purpose. You retain ownership of any data you input into the Service.

7. Disclaimer of Warranties

While our calculations are based on established statistical methods (including R statistical computing libraries), the Service is a tool to assist your analysis and is not a substitute for professional statistical consultation.

Important: For clinical trials, regulatory submissions, or high-stakes decisions, we strongly recommend validation by a qualified statistician. Zetyra does not guarantee the accuracy, completeness, or suitability of calculations for any particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, Zetyra shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Zetyra and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. Scheduled maintenance will be announced in advance when possible.

11. Termination

We reserve the right to suspend or terminate your account for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
